The New York State Gas Ban is Upheld in Federal Court
The federal court for the Northern District of New York dismissed a challenge to New York State’s “gas ban” legislation. The plaintiffs included NAHB and the New York State Builders Association (NYSBA), and claimed the New York law was under the authority of the Energy Policy and Conservation Act (EPCA). Starting in 2026, the legislation phases out natural gas appliances and infrastructure in certain new buildings including gas stoves. New York would be the first state to effectively ban natural gas connections in new homes and buildings.
